THE RELATED
The related is the bond that exists between individuals who descend from the same person.
Legally it defines:
-
kinship in a straight line: that existing between the people of which one descends from the other (for example, father and son);
-
collateral relationship: the relationship between people who, despite having a common ancestor, do not descend from each other (for example, brothers and sisters).
This distinction is relevant for the purpose of calculating the degree of kinship itself. In particular:
-
in a straight line: the degree of kinship is given by the number of generations, without counting the older one (for example, father and son are first degree relatives among them);
-
in the collateral line: the degree of relationship is given by the number of generations from one person to the common ancestor and from these to the other person, without counting the common ancestor (for example, brothers and sisters are second-degree relatives among them ).
It is therefore good to dispel the misunderstanding in which we often fall into common language: for example, the so-called "first cousins" are actually relatives of the fourth degree among themselves.
The degree of kinship is important because, in general, the law does not recognize the bond of kinship beyond the sixth degree. This means, for example, that people linked to each other by a more distant relationship do not have any legitimate claim among themselves in their respective successions.
Thanks to the recent rules on the recognition of natural children, our civil code expressly establishes that:
-
kinship is the bond between people who descend from the same jamb, both in the event that the filiation took place within the marriage, both in the event that it took place outside of it, and in the event that the child it is foster;
-
all children have the same legal status.
As a result, nowadays, there is no longer any difference between children born inside and outside the marriage of parents, both from a personal and patrimonial point of view.
